Bryce A. Pashler

Bryce Pashler focuses on all aspects of litigation.  He has extensive experience in government and internal investigations, complex civil trials and appeals, securities and M&A litigation, insurance coverage, arbitration and bankruptcy.  Mr. Pashler has represented clients in a wide variety of industries, including manufacturing, accounting, insurance, banking, private equity and pharmaceutical.

Prior to joining Belin McCormick, Mr. Pashler was a litigator for over a decade with Simpson Thacher & Bartlett in New York, where he worked on several high-profile matters, including representing the top officers of Lehman Brothers in the myriad of government investigations and civil litigation arising out of the largest bankruptcy in history, and representing a major investment bank in litigation arising out of the collapse of Enron.

Representations include:

  • Defending Princeton University in a closely-watched taxpayer challenge to Princeton’s property tax exempt status as an educational institution under New Jersey law.
  • Successfully obtaining approval of a settlement agreement in a contested bankruptcy hearing allowing for complete recovery for his client in In re Magnetation bankruptcy in Minnesota.
  • Defended several former officers of Lehman Brothers in multiple government investigations and securities litigation, including representing witnesses testifying before the United States House of Representatives Committee on Government Oversight and Reform, the SEC, the Financial Crisis Inquiry Commission, and other government agencies.
  • Represented insurance companies in coverage and reinsurance disputes over asbestos and environmental pollution liabilities in all stages of trial and appeal in state and federal courts.  Engagements included a three month bench trial in New Jersey state court concerning coverage for asbestos liabilities for a manufacturer of safety equipment, and obtaining summary judgment on coverage for remediation costs of a defense company for manufacturing and disposal sites throughout Long Island.
  • Defended financial institutions and other companies in state and federal courts, including issuers and underwriters of mortgage-backed securities and auction-rate securities, major pharmaceutical companies in 10b-5 securities cases alleging misrepresentations of the side-effects of blockbuster drugs, and a major investment bank in litigation related to the collapse of Enron.
  • Extensive trial and arbitration experience, including bet the company arbitrations representing the Hanwha group against an agency of the Korean government in a dispute over the sale of a life insurance company, and a major accounting/consulting firm in a dispute over the enforceability of non-compete clauses in an alternative practice structure.

Bryce received his B.A., with distinction and with honors from the University of Michigan with degrees in history and philosophy, where he received the William J. Branstrom Prize.  He received his J.D. from New York University School of Law, where he was a Robert McKay Scholar and an editor on the Annual Survey of American Law.
